Freedom Temp Fence LLC — Residential Fence Installation Contract

This agreement (“Contract”) is between Freedom Temp Fence LLC (“Company”) and the Customer identified in the attached quote (“Customer”). By approving this Contract or the attached quote, the Customer agrees to the following terms:

1. Scope of Work

The specific work, materials, fence type, lengths, gates, and other details are defined in the attached quote. This Contract incorporates the quote by reference. The quote and this Contract together form the agreement between the parties.

2. Change Orders

Any changes, additions, or deviations from the original quote must be documented in writing and signed by both parties. Extra materials, labor, or time may result in additional charges. Verbal requests do not obligate the Company to perform work for free.

3. Property Line & Survey

The Customer is responsible for confirming property lines and obtaining a professional survey if desired. The Company will install the fence along the provided property line but is not responsible for disputes or claims related to property lines.

4. Site Preparation & Access

The Customer must clear the installation area, mark utilities, sprinklers, irrigation systems, or invisible fences, and provide safe, level, and accessible work areas. Delays or additional charges may occur if the site is not ready. The Company is not responsible for damage to unmarked utilities or underground systems.

5. Payment & Material Ownership

• Deposit: 50% of the total quote is due upon approval of the quote.
• Balance: Due upon completion or as stated in the quote.
• Materials remain the property of the Company until full payment is received. Partial completion does not transfer ownership.
• Late payments may incur interest, collection costs, and lien rights.

6. Liability & Warranty

The Company warrants workmanship described in the quote for 12 months from the completion date. The Company is not responsible for pre-existing conditions, weather-related damage, pets, misuse, or customer negligence. The Company is also not liable for damage to sprinklers, irrigation, or other underground systems not marked by the Customer.

7. Weather & Other Uncontrollable Events

The Company is not liable for delays or damage caused by weather, natural disasters, labor strikes, or other events outside its control.

8. Subcontractors

If subcontractors are used, the Company is ultimately responsible for their work but is not liable for actions beyond the Company’s direct control.

9. Dispute Resolution & Governing Law

This Contract is governed by the laws of Oregon and Washington. Any disputes will be resolved in the appropriate courts of those states.

10. Acceptance

By approving the attached quote or signing this Contract, the Customer acknowledges and agrees to all terms stated above.
