Freedom Temp Fence LLC – Temporary Fence Rental Terms & Conditions

These Master Rental Terms & Conditions ("Terms") govern all estimates, proposals, quotes, work orders, invoices, deliveries, installations, rentals, services, and transactions provided by Freedom Temp Fence LLC ("Company"). These Terms are incorporated into and made part of every quote, estimate, invoice, service order, and rental agreement issued by the Company.
By approving a quote, authorizing work, accepting delivery, requesting services, or making payment, the Customer agrees to be bound by these Terms.
1. Definitions
Company: Freedom Temp Fence LLC
Customer: The individual, business, contractor, or entity renting Fence Materials
Fence Materials / Equipment: Temporary fence panels, stands, posts, gates, bracing, sandbags, privacy screening, and related components
Project Site: The location where Equipment is delivered, installed, stored, used, or removed.
2. Ownership
All Fence Materials remain the sole property of the Company. The Customer may not:
Move Fence Materials without written authorization
Sell, transfer, encumber, modify, or attach items to Fence Materials
Unauthorized movement, modification, or misuse may result in additional charges and liabilities.
3. Rental Term & Minimums
The rental term ("Initial Rental Term") shall be the duration specified in the approved quote, estimate, proposal, invoice, or service agreement and shall begin on the date Equipment is installed or delivered.
The full rental charge for the Initial Rental Term shall be invoiced upon contract acceptance, delivery, or installation, as determined by the Company.
The Initial Rental Term is based on the number of days specified in the approved quote and is non-refundable once Equipment has been installed.
Equipment remaining on site beyond the Initial Rental Term shall automatically continue on a month-to-month basis. An additional rental invoice shall be issued for each thirty (30) day extension period, or portion thereof, until all Equipment has been removed by the Company. Extensions are not prorated. Early Removal does not result in discounted pricing.
Customer shall provide a minimum of seven (7) calendar days' notice for removal requests. Rental charges continue until actual removal of Equipment, regardless of delays, site issues, or early removal requests.
4. Additional Billable Work & Site Access
Quoted pricing is based on the scope of work, quantities, site conditions, and site access represented at the time of quoting.
Additional charges may apply for changes in scope, including but not limited to:
• Additional fence panels, gates, posts, stands, braces, sandbags, screening, or other materials.
• Relocation, expansion, reduction, reconfiguration, or modification of installed fencing.
• Restricted, delayed, obstructed, or unsafe site access requiring additional labor, hand-carrying of materials, special equipment, remobilization, or return trips.
• Emergency, after-hours, weekend, expedited, or unscheduled service requests.
• Site conditions differing from those represented at the time of quoting.
• Damage, loss, theft, vandalism, vehicle impact, equipment impact, or unauthorized movement of Equipment.
Additional work, materials, labor, equipment, or rental extensions may be invoiced separately and are due according to the Company's payment terms.Customer must provide safe, clear access for delivery and installation, and mark all underground utilities.
Trip, standby, or re-mobilization fees may apply if access is denied or unsafe.
The Company is not responsible for damage to unmarked utilities.
5. Use Restrictions
Fence Materials may not be used for:
Permanent structures, buildings, or utilities
Vehicles, trailers, scaffolding, or machinery
Shelters, tarps, signs, banners, or loads without prior written approval
Crowd loading, climbing, or uses beyond design intent
Customer must maintain clearance to prevent displacement or damage.
6. Weather & Screening Disclaimer
Wind and severe weather may cause Fence Materials to shift or fall.
Privacy or wind screening may require additional bracing at Customer expense.
Company is not liable for weather-related property damage, site damage, or injury.
7. Damage, Loss & Theft
Customer assumes responsibility for all Fence Materials until removed by the Company.
Damaged or missing materials are billed at full replacement cost.
Stolen equipment must be reported to law enforcement; reporting does not remove payment responsibility.
8. Relocation & Emergency Service
Additional charges may apply for relocations, layout changes, emergency or after-hours service, or services caused by site changes.
9. Payment Terms
The Company may require full payment of the Initial Rental Term, delivery charges, installation charges, and other applicable fees prior to delivery or installation of Equipment.
For larger projects or approved commercial accounts, the Company may, at its sole discretion, offer alternative billing arrangements, progress billing, installment billing, or credit terms. Any such arrangements must be approved by the Company and may be modified or revoked at any time.
Unless otherwise stated on the applicable invoice, payment is due Net 15 from the invoice date.
Additional invoices may be issued at any time for:
• Rental extensions beyond the Initial Rental Term.
• Additional materials, equipment, labor, or services.
• Changes in scope, quantities, site conditions, or access conditions.
• Damage, loss, theft, vandalism, or replacement of Equipment.
• Any other charges authorized under these Terms.
Past-due balances may accrue interest at the rate of 1.5% per month (18% annually), or the maximum rate permitted by law, whichever is less.
Customer shall be responsible for all costs incurred in collecting unpaid balances, including collection agency fees, attorney fees, court costs, filing fees, and other reasonable collection expenses.
Failure to make payment when due constitutes a material breach of this Agreement. The Company may suspend services, withhold additional work, remove Equipment, require advance payment, revoke credit privileges, or pursue any other remedy available under law.
10. Removal for Nonpayment
Outstanding payment at month-end may trigger notice of intent to remove Fence Materials.
Removal for nonpayment may occur at month-end, without liability, and does not waive the Company’s right to recover unpaid charges, damages, or replacement costs.
11. Indemnity & Liability
Customer agrees to indemnify and hold the Company harmless from claims, damages, liabilities, or injuries arising from the presence, use, or failure of Fence Materials, except for gross negligence by the Company.
Company is not liable for personal injuries, vehicle/equipment damage, or delays caused by weather, labor, or material shortages.
12. Governing Law
These Terms are governed by the laws of Oregon and Washington.
Disputes will be resolved in the appropriate courts of these states.
13. Acceptance of Terms
Customer agrees to these Terms when any of the following occur:
Approving or signing an estimate, work order, or service agreement
Submitting payment or deposit
Delivery or installation of Fence Materials
