Freedom Temp Fence LLC — Temporary Fence Rental Terms & Conditions

These Terms & Conditions govern the rental, delivery, installation, use, and removal of temporary fencing and related materials provided by Freedom Temp Fence LLC (the “Company”). By approving an estimate, signing a contract, or submitting payment, the Customer agrees to be bound by these Terms.

1. Definitions

Company: Freedom Temp Fence LLC.

Customer: The individual, business, contractor, or entity renting Fence Materials.

Fence Materials / Equipment: Temporary fence panels, stands, posts, gates, bracing, sandbags, privacy screening, and related components.

2. Ownership of Fence Materials

All Fence Materials remain the sole property of the Company. The Customer obtains no ownership interest and may not:

  • Move Fence Materials without written authorization
  • Sell, transfer, encumber, modify, or attach items to Fence Materials

Unauthorized movement, modification, or misuse may result in additional charges and liabilities.

3. Rental Term & Billing

  • Rental term begins on the Installation/Delivery Date and continues until the Company removes all Fence Materials.
  • Rental automatically renews and continues to bill until the Company regains possession of Fence Materials.
  • Partial billing periods are chargeable and not prorated unless otherwise agreed in writing.

4. Delivery, Installation & Site Access

The Customer agrees to provide safe, clear access for delivery trucks and installation crews, and to identify and mark all underground utilities prior to installation. The Customer is responsible for ensuring placement complies with local rules and site requirements.

If the Company arrives and cannot safely access the site, a trip or standby fee may apply. The Company is not responsible for damage to unmarked utility lines.

5. Use Restrictions

Fence Materials may NOT be used for or attached to:

  • Permanent structures, buildings, or utilities
  • Vehicles, trailers, scaffolding, or machinery
  • Shelters, tarps, signs, banners, or loads without prior approval
  • Crowd loading, climbing, or other uses that exceed design intent

The Customer must maintain reasonable clearance around Fence Materials to prevent displacement or damage.

6. Weather, Wind & Screening Disclaimer

The Customer understands that wind and severe weather can cause Fence Materials to shift or fall. Privacy or wind screening increases wind load and may require additional bracing at the Customer’s expense.

The Company is not liable for property damage, site damage, or injury arising from weather-related movement, blow-down, or failure of Fence Materials.

7. Damage, Loss, Theft & Vandalism

The Customer is responsible for all damage, loss, or theft occurring after installation, including missing or damaged panels, stands, gates, bracing, sandbags, and screening. The Customer is also responsible for graffiti or signage removal.

If equipment is stolen, the Customer must file and provide a police report to the Company.

8. Relocation, Site Changes & Emergency Service

Additional charges may apply for relocation or layout modifications, emergency or storm-response service calls, and any services requested outside normal business hours.

9. Payment Terms & Lien Rights

Invoices are due upon receipt unless otherwise stated. Past-due balances may incur late fees, interest, collection costs, and legal remedies.

The Company reserves the right to file a construction lien, UCC claim, or similar claim for unpaid balances, damage, or replacement costs in accordance with the laws of Oregon and Washington.

10. Indemnity & Limitation of Liability

The Customer agrees to indemnify and hold the Company harmless from claims, damages, liability, or injury arising out of the presence, use, or failure of Fence Materials, except to the extent caused by the Company’s gross negligence.

The Company is not responsible for personal injuries, vehicle or equipment damage, or delays caused by weather, labor shortages, or material shortages.

11. Governing Law

These Terms are governed by the laws of the States of Oregon and Washington. Any disputes will be resolved in the appropriate courts of those states.

12. Acceptance of Terms

Customer acknowledges acceptance of these Terms when any of the following occur:

  • Customer approves or signs an estimate, work order, or service agreement; or
  • Payment or deposit is made; or
  • Fence Materials are delivered to the site.
