Freedom Temp Fence LLC – Temporary Fence Rental Terms & Conditions

These Terms & Conditions govern the rental, delivery, installation, use, and removal of temporary fencing and related materials provided by Freedom Temp Fence LLC (the “Company”). By approving an estimate, signing a contract, authorizing work, or submitting payment, the Customer agrees to be bound by these Terms.
1. Definitions
Company: Freedom Temp Fence LLC
Customer: The individual, business, contractor, or entity renting Fence Materials
Fence Materials / Equipment: Temporary fence panels, stands, posts, gates, bracing, sandbags, privacy screening, and related components
2. Ownership
All Fence Materials remain the sole property of the Company. The Customer may not:
Move Fence Materials without written authorization
Sell, transfer, encumber, modify, or attach items to Fence Materials
Unauthorized movement, modification, or misuse may result in additional charges and liabilities.
3. Rental Term & Minimums
Rental begins on the Installation/Delivery Date and continues until the Company removes all Fence Materials.
Rentals are subject to a three (3) month minimum, regardless of usage. Minimum charges are non-refundable.
Billing:
Invoices are issued on the 1st of each month.
Partial months are billed as full months; no proration or credit is given.
Small Projects (<300 LF): Minimum rental plus delivery/handling invoiced in full at installation.
Large Projects (≥300 LF): Monthly billing on the 1st; minimum is satisfied through consecutive monthly invoices. Any unpaid portion of the minimum is invoiced immediately upon removal.
Rental charges continue until fencing is removed by the Company, regardless of delays, site issues, or early removal requests.
4. Delivery, Installation & Site Access
Customer must provide safe, clear access for delivery and installation, and mark all underground utilities.
Trip, standby, or re-mobilization fees may apply if access is denied or unsafe.
The Company is not responsible for damage to unmarked utilities.
5. Use Restrictions
Fence Materials may not be used for:
Permanent structures, buildings, or utilities
Vehicles, trailers, scaffolding, or machinery
Shelters, tarps, signs, banners, or loads without prior written approval
Crowd loading, climbing, or uses beyond design intent
Customer must maintain clearance to prevent displacement or damage.
6. Weather & Screening Disclaimer
Wind and severe weather may cause Fence Materials to shift or fall.
Privacy or wind screening may require additional bracing at Customer expense.
Company is not liable for weather-related property damage, site damage, or injury.
7. Damage, Loss & Theft
Customer assumes responsibility for all Fence Materials until removed by the Company.
Damaged or missing materials are billed at full replacement cost.
Stolen equipment must be reported to law enforcement; reporting does not remove payment responsibility.
8. Relocation & Emergency Service
Additional charges may apply for relocations, layout changes, emergency or after-hours service, or services caused by site changes.
9. Payment Terms
Invoices issued on the 1st of the month; one-time fees billed at installation.
Due Date: Net 15 (payment due by the 15th).
Courtesy reminders may be sent on the 7th. Non-receipt does not excuse payment.
Late payments may incur fees, interest, and collection costs.
Nonpayment is a material breach; Company may suspend service, withhold removal, or issue notice of removal.
10. Removal for Nonpayment
Outstanding payment at month-end may trigger notice of intent to remove Fence Materials.
Removal for nonpayment may occur at month-end, without liability, and does not waive the Company’s right to recover unpaid charges, damages, or replacement costs.
11. Indemnity & Liability
Customer agrees to indemnify and hold the Company harmless from claims, damages, liabilities, or injuries arising from the presence, use, or failure of Fence Materials, except for gross negligence by the Company.
Company is not liable for personal injuries, vehicle/equipment damage, or delays caused by weather, labor, or material shortages.
12. Governing Law
These Terms are governed by the laws of Oregon and Washington.
Disputes will be resolved in the appropriate courts of these states.
13. Acceptance of Terms
Customer agrees to these Terms when any of the following occur:
Approving or signing an estimate, work order, or service agreement
Submitting payment or deposit
Delivery or installation of Fence Materials
